Terms

These Terms apply to all contracts for the use of MatchAnalyzr concluded between the Provider and consumers within the meaning of § 13 BGB (German Civil Code). Conflicting terms of the User, or terms deviating from these Terms, are not recognized unless the Provider expressly agrees to their validity in writing.

MatchAnalyzr is a personalized analysis and statistics tool for football data. Users can compile individual dashboards with widgets covering leagues, teams, and players. The service is currently in a beta phase; individual features may change, be extended, or discontinued.

The data, statistics, and derived metrics displayed (e.g. analysis scores) originate from external data providers. The Provider gives no guarantee as to the accuracy, completeness, or timeliness of this data. MatchAnalyzr provides statistical information and analysis only and does not constitute betting, investment, or other financial advice. Decisions the User makes based on the displayed data, including in connection with sports betting, are made at the User's own risk.

Automated extraction (scraping), commercial resale, or any other unauthorized redistribution of the content provided through MatchAnalyzr is prohibited.

Using MatchAnalyzr requires creating a user account. The User must provide truthful information upon registration and keep it up to date in the event of changes. Login credentials must be kept confidential and protected from access by third parties.

As a rule, only one user account may be created per person. The User is liable for all activities carried out using their login credentials, insofar as the User is responsible for the misuse.

MatchAnalyzr is offered in the Free, Pro, and Premium plans. The current scope of services and applicable prices can be found in the pricing section on the homepage at www.matchanalyzr.com/en/#pricing. All stated prices are final prices. In accordance with § 19 UStG (German small business regulation), no VAT is charged; should the provider become subject to VAT in the future, the stated prices are deemed to include the applicable statutory VAT.

Paid plans (Pro and Premium) can be billed monthly or annually. With annual billing, the price corresponds to ten times the monthly price (two months are provided free of charge). Time-limited early-bird discounts (e.g. a permanent 50% discount) are disclosed at the time the contract is concluded and apply for the duration of the uninterrupted subscription.

Payment processing is carried out via an external payment service provider. Paid subscriptions automatically renew for the chosen billing period (monthly or annually) unless cancelled in time before expiry.

A change to a higher-tier plan or from monthly to annual billing (upgrade) takes effect immediately. The difference to the amount already paid is charged on a pro-rata basis for the remainder of the billing period via the payment method on file.

A change to a lower-tier plan or from annual to monthly billing (downgrade) takes effect at the end of the current billing period; until then, the previous plan remains available with its full scope of features. Amounts already paid are not refunded pro rata in the event of a downgrade.

If, after a downgrade, the number of items the User has created exceeds the new plan limit, the excess content is automatically reduced: for dashboards, the most recently used dashboards are retained up to the new limit and any excess dashboards are deleted; for the watchlist (tracked teams and players), the oldest entries are removed until the new limit is reached.

Paid subscriptions may be cancelled by the User at any time, effective at the end of the current billing period. Cancellation is carried out via the account settings within the application or via the publicly accessible cancellation page at www.matchanalyzr.com/en/cancellation/. Until the end of the billing period, the booked plan remains usable with its full scope of features; amounts already paid are not refunded.

The right of both parties to terminate for good cause remains unaffected. The Provider may terminate the contract by ordinary notice with reasonable notice period, and may terminate for cause if the User violates these Terms, in particular § 2(3).

Consumers who conclude a distance contract are entitled to a statutory right of withdrawal. Details, in particular the withdrawal period and the consequences of withdrawal, are set out in the separate withdrawal notice at www.matchanalyzr.com/en/withdrawal/.

The Provider strives for reasonable, uninterrupted availability of MatchAnalyzr but cannot guarantee it. Maintenance work, technical faults, and the beta nature of the service may result in temporary restrictions or interruptions. No claim to a specific level of availability or response time exists, unless otherwise specified below.

The Provider is liable without limitation for intent and gross negligence, and for damages resulting from injury to life, body, or health. For damages resulting from slightly negligent breach of material contractual obligations (cardinal obligations), the fulfillment of which is essential for the proper performance of the contract and on the observance of which the User may regularly rely, the Provider is liable only up to the amount of foreseeable damage typical for this type of contract at the time the contract was concluded.

In all other respects, the Provider's liability for slight negligence is excluded. The above limitations of liability do not apply to claims under the German Product Liability Act.

The Provider is not liable for damages incurred by the User as a result of decisions made on the basis of the data, statistics, or analysis scores displayed in MatchAnalyzr, in particular in connection with sports betting or other financial decisions.

The Provider may amend these Terms with effect for the future, to the extent necessary to adapt to changed legal requirements, technical developments, or a changed market situation, and provided the change does not unreasonably disadvantage the User. The User will be informed of material changes in text form (e.g. by email) at least four weeks before they take effect.

If the User does not object to the amended terms within four weeks of receiving the notice, the changes are deemed accepted. In the notice, the Provider will separately draw the User's attention to this right of objection and to the legal consequences of failing to object. In the event of an objection, the User has a right of extraordinary termination.

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection provisions of the country in which the User has their habitual residence remain unaffected, insofar as they grant the User more extensive protection.

The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of § 36 VSBG.

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provision.
